CALL MEETING TO ORDER

 

Supervisor Staub Spiegel called the 09/08/08 Regular Town Board meeting to order at 7:00 PM.

 

MINUTES

 

Councilor Donald Trombly made a motion that the minutes of the 08/11/08 regular Town Board meeting be approved as submitted by the Town Clerk, seconded by Councilor Cathy Devins.

The Supervisor and Town Clerk August monthly reports submitted to Board for review and filed.

 

T/J Dunlop and T/J Gagnier July monthly reports submitted to Board for review and filed.

 

The DCO, David Underwood, August monthly report submitted to Board for review and filed.

 

PUBLIC COMMENT

 

            RONALD AND ROSE BAKER

 

Ronald and Rose Baker, 8920 Rt. 22, discussed updating their deck and bad odors from outside stoves. Advised them to check with Bld. Code Officer.

 

Ronald Baker requested a blind person sign for Rt. 22. Supervisor Spiegel advised him to submit a letter of request and it will be forwarded to NYS DOT as Rt. 22 is a State road.

 

Baker also stated that the sidewalk along Rt. 22 in Sciota is in need of repair.

 

            RENATE PETERSON

 

Renate Peterson, 1276 Fiske Rd. questioned the status of Fiske Rd. She was advised that she would have to contact the Clinton County Highway Dept. as it is a County Road.

 

ATTORNEY FOR THE TOWN REPORT

 

            Attorney Heidi Dennis for William Favreau had no report.

 

HIGHWAY SUPERINTENDENT REPORT

 

            Highway Supt. Richard Lewis reports:

 

á      On the cost and availability of salt on State Bid. The New State bid is $99.67 per ton.

á      The status of the generator for the Town garage.

á      Paving and shoulder work done. Mowing almost done.

 

TOWN COUNCIL ITEMS

 

Councilor Christopher Latremore Discussed The Following With The Board:

 

á      That David Martin is interested in serving on the committee for the Town Hall.

á      Swings and Youth equipment being painted by inmates.

á      Availability of Grants.

á      Status of JCEO obtaining grant to update West Chazy Town Hall Heating.

á      Availability of State Contact for heating fuel.

á      Status of County contract for snow removal.

á      Garage doors and what needs to be done to open them manually.

á      Status of GIS computer software and data entry.

Councilor Donald Trombly Discussed The Following With The Board:

 

á      Increases in insurance for new budget .

 

SUPERVISOR ITEMS

 

            Supervisor Staub Spiegel reports:

 

á      New budget request of $190 more for Dog Control.

á      T/J James Gagnier and Court Clerk Constance Gagnier submitted their letter of retirement effective September 16, 2008.

á      T/J Robert Dunlop would like the need of a Court Clerk for the whole court, be advertised to work 4 hours a day as well as work on court night at a beginning salary of $15,000/year.

á      T/J Robert Dunlop inquired about getting the balance of T/J Gagnier and Court Clerk GagnierÕs salary after September 16, 2008.

á      Reimbursement check received from Bernier and Carr for sewer bill.

á      North Countryman newspaper requests the Town to purchase an ad to honor the Fire Department. Attorney for the Town to check the legality. If legal, the consensus of the board was to purchase an eighth of a page for $150.00.

á       JCEO wants an increase of $272.00 for 2009 budget.

á      Town Assessor requests permission to attend a one day course in Lake Placid.

á      Having the hard drives of surplus computers cleaned at no cost to the Town.

 

AWARDING BID FOR SURPLUS COMPUTER EQUIPMENT

Discussion -

 

WHEREAS the Town was in receipt of only one bid for some of the surplus computer equipment;

 

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby accept the sole total bid of $325.00 for three surplus computers and two printers from Scott R. Bechard 284 Trombly Lane, Chazy, NY.

 

2009 BUDGET WORKSHOP MEETING

Councilor Jerry Deno made a motion to adopt the following resolution, seconded by Councilor Cathy Devins.

            WHEREAS, the proposed tentative budget for 2009 has to be presented to          the Town Board;

 

            NOW, THEREFORE BE IT RESOLVED, that the Chazy Town Board does hereby assign 7:00 PM, Monday, October 6, 2008, at the Chazy Town Hall, as a special workshop meeting for the Town Clerk to present the proposed tentative 2009 budget; and

 

            FURTHER RESOLVED, that the Town Clerk advertises the meeting in the official newspaper.

 

 

á      Supervisor Staub Spiegel discussed putting fluoride in water system. Councilor Christopher Latremore said no. It was consensus of the Board to conduct a survey of the Water District users.

 

RETIREMENT OF T/J JAMES GAGNIER AND COURT CLERK CONSTANCE GAGNIER

WHEREAS, Court Clerk Constance Gagnier notified the Town of her retirement from Court Clerk by letter;

 

            NOW, THEREFORE, BE IT RESOLVED that the Chazy Town Board does hereby accept the letters of retirement from Town Justice James ÒMikeÓ Gagnier and Court Clerk Constance Gagnier, both effective September 16, 2008.

 

WATER TESTING AT RESIDENTS EXPENSE

Discussion -

 

WHEREAS the Town of Chazy Water District takes daily samples of its water to ensure it meets the requirements regulated by New York State Department of Health;

 

            NOW, THEREFORE, BE IT RESOLVED that the Chazy Town Board does hereby determine that should a resident request a water test sample, they be referred to Life Science Laboratories or Endyne Laboratories and such cost for all water testing will be at the residents expense.

 

RESOLUTION AUTHORIZING EXTRA MONEY FOR BUILDING THE NEW BATHROOM AT CHAZY RECREATION PARK USING GENERAL TOWN BUILDING CONSTRUCTION TYPE CAPITAL RESERVE FUNDS SUBJECT TO PERMISSIVE REFERENDUM

 Discussion – In future there will be a need to get better estimates.

 

WHEREAS, Supervisor Staub Spiegel, requests extra money for new bathroom being built at the Chazy Recreation Park with funds to come out of General Building Construction Type Capital Reserve Funds;

 

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize extra money for the new bathroom being built at the Chazy Recreation Park at an amount of not more than $5,000.00, of which would come from the General Building Construction Type Capital reserve fund, subject to permissive referendum; and

 

            FURTHER RESOLVED, that the Town Clerk advertise, in the Press-Republican a notice of adoption of resolution subject to permissive referendum, authorizing use of General Building Construction Type Capital reserve funds to make such improvements, not exceeding $5,000.00.

 

SUPERVISOR AUTHORIZATION FOR MAINTENANCE DEPARTMENT TO MAKE PURCHASES OVER $100.00

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize Patricia Ayer to attend the one day course, Residential Style, Construction Grade, & Condition to be held October 10, 2008 at a cost of $95.00 Plus mileage to Lake Placid; and further

           

            RESOLVED, that mileage and the course fee be paid out of her school appropriation account.
