NOTICE OF PUBLIC HEARING

UPON PRELIMINARY BUDGET FOR THE YEAR 2008

NOTICE IS HEREBY GIVEN that the preliminary budget for the fiscal year beginning January 1, 2008, has been completed and filed in the office of the Town Clerk at Chazy, NY, where it is available for inspection by any interested persons at all reasonable hours. Please present any questions on the budget to the Town Clerk during office hours prior to the date of the public hearing.

FURTHER NOTICE is hereby given that the Town Board of the Town of Chazy will meet and review said Preliminary Budget and hold a Public Hearing thereon at the Town Hall in Chazy, NY, on Thursday, November 8, 2007 at 7:00 PM, and at such hearing any person may be heard in favor or against any item or items therein contained. PURSUANT TO SECTION 113 OF TOWN LAW, the proposed salaries of the following Town elected Officers are hereby specified as follows: Supervisor, $14,500; Councilors, 4 @ $3,400 each; 2 Town Justices, @ $17,500 each; Town Clerk/Tax Collector/Registrar/RMO combined $18,820; and Highway Superintendent, $39,000.

All interested citizens are invited to attend and make written or oral comments if desired.

NOTICE IS ALSO GIVEN that the regular monthly meeting for the month of November of the Chazy Town Board, will be on Thursday November 8, 2007 rather than the usual night, the second Monday of the month, after the public hearings.

PUBLIC HEARING - FOR THE TOWN OF CHAZY 2008 FIRE PROTECTION CONTRACTS/BUDGET

NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that a public hearing will be held by the Town Board, Town of Chazy, Clinton County, New York on Thursday November 8, 2007, immediately following the public hearing on the 2008 preliminary budget at 7:00 PM, at the Chazy Town Hall, for the purpose of considering contracts for the year 2008 with the Chazy and West Chazy Fire Districts, each of which said contracts shall be for fire protection to Town of Chazy Fire Protection District, said contracts to be upon the following general terms:

(a) Chazy and West Chazy Fire Districts shall answer and attend all fire calls in said District.

(b) For such services, Chazy Fire District shall be paid the sum of $113,600 and West Chazy Fire District shall be paid the sum of $67,863.

(c) Chazy Fire District shall maintain and operate fire station at 9666 Rte 9 Chazy, NY. West Chazy Fire District shall maintain and operate fire station at 7656 Rte 22 West Chazy, NY.

(d) Each fire company shall insure all of its equipment against all liability and shall protect the Town of Chazy from liability for any accident in which any fire company vehicle may be involved.

(e) Each contract shall continue until December 31, 2008.

(f) Such other incidental terms as may be necessary or proper.

            Attorney William Favreau reports:

 

¯    That the Kinsley Road Bridge transfer and paperwork have been completed.

¯    The flood insurance law was recorded and acknowledged by DEC.

¯    That the Art. 78 Kalvaitis case is in litigation status.

 

HIGHWAY SUPERINTENDENT REPORT

 

            Highway Supt. Richard Lewis reports:

 

¯    That Cemetery Road has been re-paved.

¯    Nortrax has allowed the Hwy. Dept. the use of a backhoe while waiting for delivery of the new one purchased by the Town. Also, the use of an excavator.

¯    The trailer recently purchased has been updated and is in use.

¯    The Boas sand pit in Mooers, NY needs to be surveyed prior to applying for a new mining permit and suggests the use of Neil Carey for the work.

OPENING OF WOODSTOVE BIDS

 

1.         David Reed, Plattsburgh, NY bid $14,400.00.

2.         Samples Lawn and Garden, Chazy, NY bid $22,800.00.

 

TOWN COUNCIL ITEMS

 

            Councilor Marinus Rovers discussed the Kalvaitis mining case and the             Comprehensive Land use survey with the Board.

 

            Councilor Jerry Deno discussed the status of Town Dog Control and repair of         the West Chazy Dam.

 

            Councilor Cathy Devins advised having received a phone call requesting attention be given to the equipment and vehicles on the Randy Lamere property.

            Code Officer, Robert West, advised that a letter was sent out requesting the property be cleaned up. It was decided that Supervisor Spiegel, Code Officer            West and anyone else who wished would meet with Randy Lamere at his property on Tuesday Nov. 13, 2007 at 10:00 am to determine what needs to be     gotten rid of to be in compliance.

 

            Councilor Donald Trombly discussed the issue of street lights not working.

            Also, stated that the newly painted RR Bridge looks good.

 

SUPERVISOR ITEMS

 

            Supervisor Staub Spiegel reports:

 

¯    That the Chazy Lions Club members have painted half of the railing by the RR Bridge and are to finish it next Saturday.

 

RESOLUTION AUTHORIZING A THANK YOU LETTER TO CHAZY LIONS CLUB

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize the Supervisor to send a thank you letter to the Chazy Lions Club for painting the RR bridge railing along Old Station Dr.

 

                                                                                                                                                           

 

¯    That some sidewalks have been replaced.

¯    A new fire hydrant was installed on Church St. by Fuller Construction.

¯    New maps have been received from Bernier Carr for the Water and Sewer Districts and that there are still some discrepancies of which will be adjusted.

¯    That the Historian is resigning as of November 30, 2007. Looking for a replacement.

¯    The need to discuss water gallon allotment for apartments.

¯    Having had a Special Board meeting with Tish Biesemeyer on Wednesday November 7, 2007 about Town employeesÕ health insurance.

            WHEREAS, the Chazy Town Board having, on 11/08/2007 commencing at 7:00 PM, duly held public hearings on the preliminary budget approved by this Board and filed with the Town Clerk for the fiscal year commencing 2008, including the light districts budgets for 2008, fire protection district budget for 2008, Hamlet of Chazy Water District budget for 2008, Hamlet of Chazy Sewer District budget for 2008 and Dodge Library District for 2008 and having heard all persons desiring to be heard in the matter of the budget for this Town for such fiscal year having been fully discussed and considered;

 

NOW, THEREFORE, BE IT RESOLVED, that the 2008 preliminary budget approved and filed as aforesaid, including the Light District budgets for 2008, Fire Protection District budget for 2008, Hamlet of Chazy Water District budget for 2008, Hamlet of Chazy Sewer District budget for 2008 and Dodge Library District for 2008, is hereby adopted and established as the annual budget for this Town for the fiscal year beginning 01/01/2008 and that such annual budget as so adopted is detailed in the minutes of the proceedings of this Town Board, and be it

 

            FURTHER RESOLVED, that the Town Clerk of this Town shall prepare and certify as provided by law, duplicate copies of said annual budget hereby adopted, and deliver one of such copy to the Supervisor of the Town, and that he shall present such copy to the Board of Legislators of the County as required by law.

RE-APPLICATION FOR GRANT TO BUILD OUTDOOR GAZEBO

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize CCRS Superintendent, Kevin Mulligan to re-apply for a grant on behalf of the School and the Town for funds to put up an outdoor gazebo on CCRS property.

 

Calendar for New York State and Local EmployeesÕ Retirement System for Determining Hours Worked Each Month for Elected Officials

          NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby require a calendar be completed, every election, by each re-elected or newly elected official who is enrolling or who is currently enrolled in the New York State and Local Retirement System. Effective date January 1st, 2008; and

           FURTHER RESOLVED, that a calendar for all re-elected or newly elected officials shall contain daily detail of hours worked and duties performed directly related to the position for a sample period of a month. The calendar shall be completed for either the month of January or February following the beginning of the re-elected or newly elected official's term.

           NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby require a calendar to be completed by each appointed or re-appointed position employee every four years for those currently enrolled or who will be enrolling in the New York State and Local Retirement System. Effective date January 1st, 2008; and

           FURTHER RESOLVED, that a calendar for each appointed or re- appointed position employee shall contain daily detail of hours worked and duties performed directly related to the position for a sample period of a month. The calendar shall be completed for either the month of January or February following the beginning of a new calendar year.

 

RESOLUTION AUTHORIZING PURCHASE OF COMPUTER SERVER FROM TELEPHONE MAINTENANCE

            WHEREAS, General Equipment Type Capital Reserve Funds in the amount of      $9,618.00 was authorized by Resolution No. 97 Ð 10/03/2007, subject to      permissive referendum, to be used to purchase a new computer server             system for the Town Offices; and

 

            WHEREAS, no petition, as prescribed by (Section 91 of the Town Law)             protesting against said resolution was submitted to the Town Clerk of which a          Certificate of Town Clerk was submitted;

 

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize the Supervisor to purchase computer server equipment, for the Town Offices, from Telephone Maintenance, West Chazy, NY for $9,618.00 of which will come from pre-approved General Equipment Type Capital Reserve Funds.

 

COMPENSATION TIME EARNED UPON RETIREMENT FOR FINAL AVERAGE SALARY

            WHEREAS, the Chazy Town Board authorizes the New York State and Local EmployeesÕ Retirement System to calculate compensation time earned towards         and employeesÕ Final Average Salary;

 

            NOW, THEREFORE, BE IT RESOLVED, that compensatory time earned, during the last three years before retirement, maybe accrued up to ten (10) days each year, to be paid at the current hourly rate upon retirement. The total number of days that maybe accrued is thirty (30) days.

 

AUTHORIZED HEALTH INSURANCE CHANGES FOR TOWN OF CHAZY

AUTHORIZE HIGHWAY SUPERINTENDENT TO PURCHASE WOOD STOVE

            WHEREAS, General Equipment Type Capital Reserve Funds in the amount of      $17,000.00 was authorized by Resolution No. 100 Ð 10/09/2007, subject to      permissive referendum, to be used to purchase a new outside woodstove for the    Highway Garage; and

 

            WHEREAS, no petition, as prescribed by (Section 91 of the Town Law)             protesting against said resolution was submitted to the Town Clerk of which a          Certificate of Town Clerk was submitted; and

 

            WHEREAS, Resolution No. 100 Ð 10/09/2007 authorized the Hwy. Supt. to         receive bids of which two (2) bids were received, one each from David Reed at          $14,400.00 and Samples Lawn and Garden at $22,800.00;

 

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize the Hwy. Supt. to accept the bid from the lowest bidder, David Reed, if after review of the bid, it meets the required specifications of the bid request.
