PUBLIC HEARING - THE ADOPTION OF THE 2010 TOWN OF CHAZY BUDGET

NOTICE OF PUBLIC HEARING

UPON PRELIMINARY BUDGET FOR THE YEAR 2010

NOTICE IS HEREBY GIVEN that the preliminary budget for the fiscal year beginning January 1, 2010, has been completed and filed in the office of the Town Clerk at Chazy, NY, where it is available for inspection by any interested persons at all reasonable hours. Please present any questions on the budget to the Town Clerk during office hours prior to the date of the public hearing.

FURTHER NOTICE is hereby given that the Town Board of the Town of Chazy will meet and review said Preliminary Budget and hold a Public Hearing thereon at the Town Hall in Chazy, NY, on Thursday, November 5, 2009 at 7:00 PM, and at such hearing any person may be heard in favor or against any item or items therein contained.  PURSUANT TO SECTION 113 OF TOWN LAW, the proposed salaries of the following Town elected Officers are hereby specified as follows: Supervisor, $14,500; Councilors, 4 @ $3,600 each; 2 Town Justices, @ $18,000 each; Town Clerk/Tax Collector/Registrar/RMO combined $20,155; and Highway Superintendent, $43,050.

All interested citizens are invited to attend and make written or oral comments if desired.

NOTICE IS ALSO GIVEN that the regular monthly meeting for the month of November of the Chazy Town Board, will be on Thursday November 5, 2009 rather than the usual night, the second Monday of the month, after the public hearings.

PUBLIC HEARING - FOR THE TOWN OF CHAZY 2010 FIRE PROTECTION CONTRACTS/BUDGET

A legal notice was placed in the official newspaper on Monday, October 26, 2009 as follows:

 

NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that a public hearing will be held by the Town Board, Town of Chazy, Clinton County, New York on Thursday November 5, 2009, immediately following the public hearing on the 2010 preliminary budget at 7:05 PM, at the Chazy Town Hall, for the purpose of considering contracts for the year 2010 with the Chazy  and West Chazy Fire Districts, each of which said contracts shall be for fire protection to Town of Chazy Fire Protection District, said contracts to be upon the following general terms:

(a) Chazy and West Chazy Fire Districts shall answer and attend all fire calls in said District.

(b) For such services, Chazy Fire District shall be paid the sum of $123,600 and West Chazy Fire District shall be paid the sum of $74,856.

(c) Chazy Fire District shall maintain and operate fire station at 9666 Rte 9 Chazy, NY. West Chazy Fire District shall maintain and operate fire station at 7656 Rte 22 West Chazy, NY.

(d) Each fire company shall insure all of its equipment against all liability and shall protect the Town of Chazy from liability for any accident in which any fire company vehicle may be involved.

(e) Each contract shall continue until December 31, 2010.

(f) Such other incidental terms as may be necessary or proper.

Clinton County Legislator Report

 

Clinton County Legislator Tom Sears reported:

 

á     That the sales tax revenue is above budget projection.

á     The NYS DEC has issued a new ÒNo Burning LawÓ and issued guide lines of municipalities.

 

SUPERVISOR ITEMS

 

            Supervisor Staub Spiegel reports:

 

á      Having received a thank-you note for the flowers honoring the death of Harold Jubert, from Barbara Jubert and family.

á      On the NYSEG natural gas survey.

á      That JCEO presently has a temporary administrator at the West Chazy office.

á      More tests are to take place in the Mayo and Cote area of the water district to see if it can be determined what the problem is.

á      That Robert Cheeseman, Town Historian, has an 1859 map of Clinton County and would like it to be preserved. Will attempt to get different estimates.

á      Health benefits - would spouse get benefits immediately upon death of the employee? Issue discussed.

á      Thanks to NYSEG for fixing a pole by the Chazy Rec. Park.

á      Maintenance of generators – Yearly maintenance just being done with repairs.

á      Having received a complaint of mud in the road. Farmers are making a concerted effort to clean off mud.

á      Update on burned out house on Miner Farm Road. Might be sold.

á      Audit update – None yet.

á      Retaining wall at the railroad under pass in need of repair. Who is responsible? To be determined.

á      Need to remind people of their responsibility to shovel their sidewalks this winter.

á      Whether or not there is a problem with drinking the water in the area of Church Street. Regularly tested.

á      Wishes everyone a Happy and safe Thanksgiving.

 

ATTORNEY FOR THE TOWN REPORT

 

            Attorney Heidi Dennis for William Favreau, reports:

 

á      On AT&TÕs possible use of the TownÕs water tank to install a cell antenna. Also, that the Town might look into modifying the townÕs local law to state that use of the Town property should be exhausted first before going with private property.

AUTHORIZATION FOR CHAZY WESTPORT COMMUNICATIONS TO INSTALL EMERGENCY PHONE JACKS IN TOWN BOARD ROOM

WHEREAS, the Chazy Town Board has adopted an Emergency Management Plan should a disaster occur; and

 

WHEREAS, it has been decided that The Chazy Town Hall would be the central Command Center should a disaster occur; and

 

WHEREAS, it would require multiple phone lines to accommodate responding emergency personal and other authorized parties to work through the disaster; and

 

WHEREAS, Chazy Westport Telephone Company has agreed to install five phone jacks at no expense to the Town that would be activated at time of disaster upon request.

 

NOW, THEREFORE, BE IT RESOLVED that the Chazy Town Board does hereby authorize Chazy Westport to install emergency phone jacks in the Town Board room in a location that can be easily accessible for such occurrence.

WHEREAS, the Town of Chazy is seeking statements of qualifications from experienced professional engineers or engineering firms to provide engineering services for the Town of Chazy Sand/Salt Storage Structure;

 

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize Leo Oliver, Town Clerk, to advertize in the Press-Republican newspaper, a request for formal written qualifications to be submitted to Leo Oliver, Town Clerk, Town of Chazy, 9631 State Rt. 9, P. O. Box 219 Chazy, NY 12921, on or before December 1, 2009 at 12:00 Noon. One original of the qualifications statement shall be submitted and clearly marked ÒRFQ – Sand/Salt Storage StructureÓ. If the qualifications statement is to be delivered by mail, provide adequate time for delivery; and

            WHEREAS, the Chazy Town Board having, on 11/05/2009 commencing at 7:00 PM, duly held public hearings on the preliminary budget approved by this Board and filed with the Town Clerk for the fiscal year commencing 2010, including the light districts budgets for 2010, fire protection district budget for 2010, Hamlet of Chazy Water District budget for 2010, Hamlet of Chazy Sewer District budget for 2010 and Dodge Library District for 2010 and having heard all persons desiring to be heard in the matter of the budget for this Town for such fiscal year having been fully discussed and considered;

 

NOW, THEREFORE, BE IT RESOLVED, that the 2010 preliminary budget be approved and filed as aforesaid, including the Light District budgets for 2010, Fire Protection District budget for 2010, Hamlet of Chazy Water District budget for 2010, Hamlet of Chazy Sewer District budget for 2010 and Dodge Library District for 2010, is hereby adopted and established as the annual budget for this Town for the fiscal year beginning 01/01/2010 and that such annual budget as so adopted is detailed in the minutes of the proceedings of this Town Board, and be it

 

            FURTHER RESOLVED, that the Town Clerk of this Town shall prepare and certify as provided by law, duplicate copies of said annual budget hereby adopted, and deliver one of such copy to the Supervisor of the Town, and that he shall present such copy to the Board of Legislators of the County as required by law.

RESOLUTION ADOPTING CHAZY FIRE PROTECTION CONTRACT - CHAZY DISTRICT

            WHEREAS, the Chazy Town Board having, on 11/05/2009 commencing at 7:02  PM, duly held a public hearing on the preliminary budget for the Fire Protection District of the Town approved by this Board and filed with the Town Clerk for the fiscal year commencing 2010, and having heard all persons desiring to be heard in the matter of the budget for this district of the Town for such fiscal year having been fully discussed and considered;

 

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize the 2010 Chazy Fire Protection Contract to appropriate $123,600 for the Chazy Fire District; and

 

            FURTHER RESOLVED, that the Supervisor be authorized to sign the contract.

            WHEREAS, the Chazy Town Board having, on 11/05/2009 commencing at 7:02                PM, duly held a public hearing on the preliminary budget for the Fire Protection District of the Town approved by this Board and filed with the Town Clerk for the fiscal year commencing 2010, and having heard all persons desiring to be heard in the matter of the budget for this district of the Town for such fiscal year having been fully discussed and considered;

 

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize the 2010 Chazy Fire Protection Contract to appropriate $74,856 for the West Chazy Fire District; and

 

            FURTHER RESOLVED, that the Supervisor be authorized to sign the contract.
