CALL MEETING TO ORDER

Supervisor Staub Spiegel called the 05/09/2011 Regular Town Board meeting to order at 7:00 PM.

MINUTES

Councilor Donald Trombly made a motion that the minutes of the 04/11/2011 regular Town Board meeting be approved as submitted by the Town Clerk, seconded by Councilor Cathy Devins.

PUBLIC COMMENT

YOUTH COMMISSION/TOM TETREAULT

Tom Tetreault advised the Town Board that the back stop on the ball field owned by the West Chazy Fire District was in need of replacement. He would like to know if the Town would pay for half if the West Chazy Fire District paid the other half. He has one quote at this time from BSN sports for a back stop and shipping of $2,134.08. He is attempting to get other quotes. The labor for the installation will be provided at no extra cost to the Town or Fire District.

AUTHORIZATION FOR TOWN TO PAY HALF FOR NEW BACK STOP CONTINGENT THAT WC FIRE DISTRICT WILL PAY OTHER HALF

Resolution: 11-57 05/09/2011

Motion by: Councilor Cathy Devins

WHEREAS, Tom Tetreault, Youth Commission Chairman, requests the purchase and installation of a new back stop on the West Chazy Fire District ball field that is used by Youth Commission ball teams; and

WHEREAS, Tom requests that the Town share the expense 50/50 with the West Chazy Fire District;

NOW, THEREFORE, BE IT RESOLVED that the Chazy Town Board does hereby authorize the Town of Chazy to pay half of the expense of a new back stop, plus shipping, for the West Chazy Fire District’s ball field contingent that the West Chazy Fire District pay the other half. The maximum Town’s share to be $1,250.00; and further

RESOLVED, that the West Chazy Fire District agree to the use of the field by Chazy Youth teams for (10) ten years.

CLINTON COUNTY LEGISLATOR REPORT

Tom Sears, Clinton County Legislator, advised that he had attended a County safety meeting and it was reported that at least 535 structures have been damaged by the flood waters. Further information may be obtained by going online to web site “clintoncountygov.com”.

Fema will not come to assess the damages until the flood waters go down as they presently are three feet above flood stage.

Town Supervisor, Staub Spiegel, advised that he had declared a state of emergency for the Town due to the flooding and that people will need to contact the Town Codes Officer before any work is done to the damaged structures.

Councilor, Christopher Latremore, commented that people would need to contact NYS DEC for approval of restoring sea walls etc.

ATTORNEY FOR THE TOWN REPORT

Attorney William Favreau reports:

Mr. Favreau spoke on the possible need to amend the sewer code.

HIGHWAY SUPERINTENDENT REPORT

Highway Supt. Richard Lewis reports:

Road damage due to flooding is minimal.
That he, with mixed emotions, will be retiring as Highway Superintendant as of June 30, 2011.

Supervisor, Staub Spiegel, thanked him for his work as Highway Superintendant and also stated that Deputy Hwy. Supt. Tim Lamica has done a hell of a job in Richard’s absence and that the Hwy Dept did a great job through all the flooding.

TOWN COUNCIL ITEMS

Thanked the Hwy. Dept. and Fire Dept. with help through the flooding.

Rules of the Recreation Parks.
Summer sports signup forms may be accessed on the Town website, “townofchazy.com”. The signups will be for baseball, softball, reading and street hockey camps.

SUPERVISOR ITEMS

Supervisor Staub Spiegel reports:

Chazy Lions club requests permission to install a hot water tank in the new bathroom/kitchen facility at the Chazy Recreation Park at no expense to the Town.
Mortgage tax is up from last year’s $14,000.00 to this year’s $22,000.00.
That there needs to be some discussion whether to rescind Resolution No. 33 of 02/14/2011 dealing with water rates.

COMPLETE HEATING SERVICE AGREEMENT FOR CHAZY T/HALL WITH HOME HEATING AND AIR CONDITIONING

The proposed resolution for the heating service agreement was tabled to allow Supervisor to obtain other quotes.

RESOLUTION TO RESCIND RESOLUTION NUMBER 33 – 02/14/2011 - WATER RATES-EXTENDED TIME AWAY/VACANT AND RESOLUTION NUMBER 151 – 12/27/2010 – AGREEMENT WITH CHAZY PUBLIC LIBRARY

WHEREAS, it has been determined that Resolution No. 33 – 02/14/2011 and Resolution No. 151 – 12/27/2010 are not in the best interest for the Town;

NOW, THEREFORE, BE IT RESOLVED that the Chazy Town Board does hereby authorize that Resolution number 33 – 02/14/2011 “Water rates extended time away/vacant” and Resolution number 151 – 12/27/2010 “Resolution Authorizing Agreement between Chazy Water and Sewer District and Chazy Public Library” is rescinded effective June 1, 2011.

RESOLUTION AUTHORIZING THE CHAZY LIONS CLUB TO INSTALL A HOT WATER TANK IN THE NEW BATHROOM AT CHAZY RECREATION PARK

WHEREAS, the Chazy Lions Club has requested permission to install a hot water tank in the new bathroom/kitchen facility at the Chazy Recreation Park to provide hot water to the kitchen area only, at no cost to Town residence;

NOW, THEREFORE, BE IT RESOLVED that the Chazy Town board does hereby grant permission to The Chazy Lions Club to install a hot water tank in the Chazy Recreation Park New bathroom/kitchen area with advisement from Tom Roberts on where to place and hook up of electricity.
