CALL MEETING TO ORDER

 

Supervisor Staub Spiegel called the 05/12/08 Regular Town Board meeting to order at 7:00 PM.

 

MINUTES

 

Councilor Cathy Devins made a motion that the minutes of the 04/14/08 regular Town Board meeting be approved as submitted by the Town Clerk, seconded by Councilor Jerry Deno.

REPORTS

 

The Supervisor and Town Clerk April monthly reports submitted to Board for review and filed.

 

T/J Dunlop and T/J Gagnier March monthly report submitted to Board for review and filed.

 

PUBLIC COMMENT

 

            WOOD STOVE COMPLAINT

 

Andre Pontbriand, 7962 State Rt. 22, West Chazy, appeared before the Board to explain his use of an outdoor wood stove and that he felt that he was in compliance with the Town Zoning Law.

 

Steven Rasco, 7973 State Rt. 22, West Chazy, reiterated his complaint of the smoke causing problems with his family not being able to enjoy being outside of his home. He also would like to see the Town amend the Zoning Law to forbid the use of the outside wood stoves during the summer months.

 

Wayne Lapier, 7913 State Rt. 22, West Chazy, stated that he did not think that a higher stack on the wood stove would help.

 

COUNTY LEGISLATOR REPORT

 

Clinton County Leg. Tom Sears reports that the sales tax income is above the projected amount.

 

ATTORNEY FOR THE TOWN REPORT

 

            Attorney William Favreau had no report.

 

HIGHWAY SUPERINTENDENT REPORT

 

            Highway Supt. Richard Lewis:

 

á      Questioned Mr. Favreau to see if he had a chance to check over the County snow removal agreement. He hadnÕt.

á      Questioned Mr. Favreau about the need of issuance of a certificate of compliance for the Kalvaitis mine before the Town purchases anything from the mine. Advised to see Codes Officer, Robert West about one being issued.

á      Reports that the roadside pick-up was complete.

á      Reports that Northern Sanitation accepted the extra for an extra $40.00 a pickup for 2 pickups.

á      Reports that the T/Garage was washed and painted inside.

á      Reports sand was picked up off the roads.

á      Reports the wood stove at the T/Garage is shut down for the summer and that it was a big savings on the use of fuel oil. 144 gal. used this year instead of 4,000 gal. in prior year.

á      Requested that No Parking Law be passed for a section of the Gonyea Rd. in Sciota by the Recreation Park.

 

PUBLIC HEARING ON LOCAL LAW NO. 3/NO PARKING GONYEA ROAD

Councilor Jerry Deno made a motion to adopt the following resolution, seconded by Councilor Cathy Devins.

WHEREAS, Hwy. Supt. Richard Lewis requests a Local Law establishing a No Parking regulation along the bounds of the Gonyea Road;

 

            NOW THEREFORE BE IT RESOLVED, that a public hearing will be held on said proposed Town of Chazy Local Law No. 3 of the Year 2008 on the 9th day of June, 2008 at 7:00 oÕclock PM at the Town Hall, 9631 Route 9, Town of Chazy, Clinton County, New York; and it is hereby further

 

            RESOLVED, that the Town Clerk is hereby authorized, and directed to publish and post a Public Hearing Notice to be published in the Press-Republican and on the sign board of the Town maintained pursuant to Town Law ¤30(6), the publication thereof, and said posting to be not less than ten (10) days, nor more than twenty (20) days, before the date set for such Public Hearing.

 

TOWN COUNCIL ITEMS

 

Councilor Christopher Latremore Discussed The Following With The Board:

 

á      The dirty water problem with the CoteÕs.

á      Questioned if NYSEG had responded to a request for extension of gas lines. Advised by Sup Spiegel that no response has been received.

á      Recreation Park tour was beneficial.

á      New assessments and what could be done to change the continued increases.

á      Thanked Sam Castine for taping and showing the Board meetings on Home Town Cable.

 

Councilor Jerry Deno Discussed The Following With The Board:

 

á      Assessments thought to be antiquated.

á      Also thought the Rec. Park tour was beneficial.

á      Questioned whether anything further has taken place since the meeting with Bernier Carr representatives.

 

Councilor Cathy Devins Discussed The Following With The Board:

 

á      Also thought the Rec. Park tour to be beneficial and things need to be addressed and updated.

 

SUPERVISOR ITEMS

 

            Supervisor Staub Spiegel reports:

 

á      A new heating system needs to be installed in the West Chazy Town hall. He received two estimates, one from Church Oil for $2,525 and another from Home Heating for $2,725. In the midst of the discussion it was asked if a propane system was looked into. Sup. Spiegel advised that he would check into it.

á      Having received a letter from Joyce Samonek, 1305 Fiske Rd. Chazy, requesting commercial water and sewer rates during the 2nd and 3rd quarters and residential for the 1st and 4th quarter of the year as she plans to operate her bed and breakfast only during the 2nd and 3rd quarter. Sup. Spiegel will check with other Towns to see how they handle such a request.

á      Receiving a request from Pat Ayer and Tom Dashnaw that permits should be issued for demolition of existing buildings.

 

TOWN HALL DISCUSSION

 

Supervisor Staub Spiegel opened for discussion with the Board, the subject of the Chazy Town Hall. Should the present Town Hall be re-constructed, remodeled or should a new building be built.

Spiegel thought that there is a problem with parking at the present town hall and it is not energy efficient. He noted that in a survey that was recently taken, the Town people did not want a new building.

Spiegel wanted to go on record that he would go along with what the people wanted but that he thought that the Town should go with a New Town Hall building as it would be more energy efficient.

 

            Councilor Christopher Latremore had questions like,

á      What would be the cost of a new building?

á      What would happen to the old Town Hall building?

á      Would the cost of re-modeling be more as he understands that it could possibly be double?

 

Supervisor Spiegel advised that as of now there are two locations that are being considered if a new building were to be built. The Chazy Recreation Park owned by the Town and property that would have to be purchased, on Route 9 adjacent to CCRSÕs soccer field, owned by GirouxÕs Grain Farms and formally part of the Duprey farm.

 

Councilor Jerry Deno would never agree to leave the Town Hall building vacant.  The Town should try to update it.

                       

Councilor Cathy Devins questioned the survey as she thought there was a lack of knowledge about the building of a New Town Hall. Also, to re-model the old Town Hall, the whole back portion should be taken down and built new.

 

Supervisor Spiegel suggested forming a committee, but the consensus of the Board was to have special work session meetings of the whole Board to determine what direction to go. Ask the people if the Town should either re-model the present Town Hall or build a new one. To help make that determination, plans and costs will be put together to help make an informed decision.

 

PLANNING BOARD REPORT

 

Planning Board Chairman, Thomas Dashnaw, reports that they had two amendments to the Zoning Law ready to present to the Town Board for approval. They would be forwarded to the Attorney for the Town for to make up a draft amendment to the Zoning Law to be presented to the Board members.

 

ADVERTISE FOR BIDS ON TOWN SURPLUS HIGHWAY EQUIPMENT

Bids will be opened at 7:00 pm, June 9, 2008 during the regular Town Board Meeting. The Town Board has the right to accept or reject any or all bids.

 

PRIVATE ROAD NAME ADDITION TO 911 LISTING/CEDAR WAY

WHEREAS, the mileage rate needs to be increased to 50.5 cents per mile from the present 40.5 cents per mile, to match the IRS allowed rate;

 

            NOW, THEREFORE BE IT RESOLVED that Chazy Town Board does hereby authorized a mileage rate of 50.5 cents per mile for Town Officials, paid after a voucher is submitted stating specific mileage reading, destination to and from, date and number of miles traveled.
