MEETING TO ORDER
Supervisor Staub Spiegel called the 03/09/09 Regular Town
Board meeting to order at 7:00 PM.
MINUTES
Councilor Donald Trombly made a motion that the minutes of the 02/09/09 regular Town Board meeting be approved as submitted by the Town Clerk, seconded by Councilor Cathy Devins.

ATTORNEY
FOR THE TOWN REPORT
Attorney
William Favreau presented the Board with a proposed resolution regarding the
removal of snow and ice improperly placed in the TownÕs rights of way. He requested
the Board look it over and may even wish to pursue the adoption of an actual
Local Law instead of a resolution.
HIGHWAY SUPERINTENDENT REPORT
Highway
Supt. Richard Lewis reports:

That the new generator is hooked up and ready to go.
Awaiting company official to check it out before starting it.
á
That he will be going to Albany Wednesday March 11,
2009 to attend a lobbing session.
á
February being an easy month on the use of salt and
sand.
á
That through the County bid, salt will be purchased
at $71/ton instead of last yearÕs figure of $99/ton.

Councilor Cathy Devins Discussed
The Following With The Board:

Advised the Board that she had received three (3)
complaints of manure spreading near their homes and is aware that there is
nothing that can be done.

The procedure of the Dog Control Officer euthanizing
a dog.
Councilor Donald Trombly Discussed
The Following With The Board:

Having received a request from Alexandra Bechard, for
another street light on Oliver Street. Will advise them to submit a written
request.

Asked if there was an update from Senior Housing.

SUPERVISOR ITEMS
Supervisor
Staub Spiegel reports:
á
That Mr. Hitchcock advised that he would not be able
to produce the requested playground equipment, for the Rec. Parks, at school at
this time. However, Sup. Spiegel was in contact with Jimmy West and he would be
willing to produce the equipment.
á
That the Board needs to check the Chazy Rec. Park for
a location of a band stand to be built by the Lions Club.
á
On the status of the Town Hall renovations and a
request for funds from the General Construction Type Capital Reserve.
á
The returns from the Water District Extension survey
wanting the extension were 9 yes and 8 no.
á
Having received a letter from Robert Cheeseman, Town
of Chazy Historian requesting $200.00 to have the Strawhatters Band at the
reception, put on by the Chazy Friends of the Library, which will follow the
dedication of marker to commemorate The Twins Ferry at Chazy Landing on July
18, 2009. Also asked that two Historical markers be installed for the year 2009
at a cost of $2,128.00 and one each year thereafter.
á
A West Chazy Group that is buying the Wesleyan Camp
in West Chazy and will continue to use it for religious purposes. Will we
continue to offer Tax exempt status? It was noted that the Assessor makes that
determination.
á
That when the bath room is done at the Chazy Rec.
Park, the question arose, do we install equipment like a stove or refrigerator
in the section to be used for concessions. It was determined that anyone who
used it would have to bring in their own equipment.
á
A need of a resolution authorizing the Supervisor to
execute the Undertaking in Connection with Highway Permits Issued by NYS DOT
agreement.
á
The need of an executive session at the end of the
meeting.
TOWN OF
CHAZY COMPREHENSIVE EMERGENCY MANAGEMENT
PLAN
Resolution: 09-38 03/09/2009

WHEREAS, the Town of Chazy needs
to revise the Town of Chazy Emergency Disaster Response Plan, Resolution No. 88
– 12/93; and
WHEREAS, Article 2-B of the
Executive Law grants to the Town Supervisor the authority to proclaim a state
of emergency in certain situations.
NOW,
THEREFORE, BE IT RESOLVED that the Chazy Town Board does hereby adopt the
ÒComprehensive Emergency Management PlanÓ, a revision, replacing the Town of
Chazy Emergency Disaster Response Plan, Resolution No. 88 – 12/93.

RESOLUTION
AUTHORIZING IMPROVEMENTS TO THE CHAZY TOWN HALL PROPERTY USING GENERAL TOWN
BUILDING CONSTRUCTION TYPE CAPITAL RESERVE FUNDS SUBJECT TO PERMISSIVE
REFERENDUM

WHEREAS, Supervisor Staub Spiegel,
requests improvements be made at the
Chazy Town Hall property;
NOW,
THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize the
afore said improvements to the Chazy Town Hall property at a cost of not more
than $15,000.00, of which would come from the General Town Building
Construction Type Capital reserve fund, subject to permissive referendum; and
FURTHER RESOLVED, that the Town Clerk
advertise, in the Press-Republican a notice of adoption of resolution subject
to permissive referendum, authorizing use of General Town Building Construction
Type Capital reserve funds to make such improvements, not exceeding $15,000.00.

renewal of the following Junk Yard licenses:
1. B & B Salvage, for the place of business on the
East side of Rte 9 South of the Hamlet of Chazy. Tax Map # 94.-1-32.1
2. B & B Salvage, for the Old Dump site on the North
side of the Macadam Rd. Tax Map # 92.-1-14.1

Library sponsored a historical marker to commemorate The Twins Ferry at Chazy
Landing; and
WHEREAS, the Chazy Historian,

UNDERTAKING
IN CONNECTION WITH HIGHWAY PERMITS ISSUED BY NYS DOT AGREEMENT

WHEREAS, the Town of Chazy from
time to time receives permits from the Department of Transportation (DOT) to
temporarily obstruct, install, construct, maintain, operate or replace any
facilities within the bounds of a State highway right-of-way, and
WHEREAS, the Town is required by
NYS DOT to indemnify or hold harmless agencies and/or officials of the State of
New York for such temporary obstructions, installations, construction or
maintenance,
NOW,
THEREFORE, BE IT RESOLVED that Staub Spiegel, and any future elected
supervisors of the Town of Chazy, is authorized to execute the Undertaking in
Connection With Highway Permits Issued by NYS DOT agreement.
