CALL MEETING TO ORDER

 

Supervisor Staub Spiegel called the 03/10/08 Regular Town Board meeting to order at 7:00 PM.

 

MINUTES

 

Councilor Donald Trombly made a motion that the minutes of the 02/11/08 regular Town Board meeting be approved as submitted by the Town Clerk, seconded by Councilor Cathy Devins.

REPORTS

 

The Supervisor and Town Clerk February monthly reports submitted to Board for review and filed.

PUBLIC COMMENT

 

            DAVID UNDERWOOD/DOG CONTROL OFFICER

 

David Underwood introduced himself to the Board as the Town of ChazyÕs new Dog Control Officer and presented a report for January and February 2008.

 

            ALAN MOONEY/JUNKYARD

 

            Alan Mooney advised that he would not be renewing his junkyard license.

 

            STEVEN RASCO/WOODSTOVE

 

Steven Rasco, 7973 Route 22, addressed the Board about a problem existing with his neighborÕs outdoor wood stove. Would like the zoning law on wood stoves changed to require that wood stoves not be used during summer months as his wife has pulmonary disease and with the neighborÕs wood stove operating in the summer the smoke hangs over the Rasco residence and are unable to enjoy their yard or use of their air conditioning as it pulls smoke into the house.

The Board advised him to present his case to the Planning Board on March 17, 2008. In the meantime the code officer will ask the owner of the wood stove to add an extension to his exhaust.

 

TYLER SPIEGEL/WATER CONTAMINATION

 

Tyler Spiegel requests that the Town Board authorize the Supervisor by resolution to contact SEMA and other municipalities for supply of water in event the Chazy Water District should ever have a problem with water contamination like nearby Champlain did.

 

RESOLUTION AUTHORIZING SUPERVISOR TO PURSUE AN AGREEMENT WITH SEMA AND OTHER MUNICIPALITIES FOR EMERGENCY WATER

Councilor Cathy Devins made a motion to adopt the following resolution, seconded by Councilor Jerry Deno.

WHEREAS, the Town of Chazy has no agreement with SEMA or other municipalities for the supply of emergency water should the water district water become contaminated;

 

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize the Supervisor to pursue an agreement with SEMA and other municipalities for supply of water for the Chazy Water District should their water supply become contaminated.

 

            NEIL CAREY/COMPREHENSIVE LAND USE PLAN

 

Neil Carey, Chairman of the Comprehensive Land Use Plan subcommittee, presented a brief overview of the final draft of the Comprehensive Land Use Plan that the subcommittee put together for the Planning and Town Boards to review and make any needed changes before its adoption.

Neil also commended everyone on the subcommittee for their dedicated work on putting the plan together.

 

            STEVEN LAPIERRE/1991/2008 COMPREHENSIVE LAND USE PLAN

 

Steven Lapierre, a member of the subcommittee, stated that the thoughts of the people in 1991 had changed very little in 2007 according to the surveys filled out by the people of the Town of Chazy. The 2008 Comprehensive Land Use Plan contains a few updates and refinements.

 

            STAUB SPIEGEL/THANK YOU

 

Supervisor Staub Spiegel thanked the Comprehensive Land Use Plan subcommittee on behalf of the Town Board for their dedicated work done on a volunteer basis.

HIGHWAY SUPERINTENDENT REPORT

TOWN COUNCIL ITEMS

 

COUNCILOR CHRISTOPHER LATREMORE DISCUSSED THE FOLLOWING WITH THE BOARD:

 

á      The status of the water at the Cote residence.

á      A time of having a meeting of the Rec. park committee.

á      Should there be a charge for Water District water used outside the district for fighting a fire outside the district.

 

COUNCILOR JERRY DENO DISCUSSED THE FOLLOWING WITH THE BOARD:

 

á      List of items that need to be taken care of at the West Chazy Town Hall.

á      The procedure of obtaining Planning Board minutes due to a request of the last minutes by Willie Kalvaitis.

á      Had anyone requested wanting to become an alternate on the Planning Board. Sup. Spiegel said, no.

á      Having received complaints of poor road conditions after last storm.

 

COUNCILOR DONALD TROMBLY DISCUSSED THE FOLLOWING WITH THE BOARD:

 

á      The status of street light repair.

 

SUPERVISOR ITEMS

 

            Supervisor Staub Spiegel reports:

 

á      That Senior Housing has been advised that they will be receiving $28,882.00 grant for seed money.

á      A public hearing for an amended backflow prevention law is needed for the April meeting.

á      On an update of Round 10 water Quality Grant.

á      Having sent a letter to Mooers to update Dog Control Officer Agreement.

á      Having sent information and pictures of the Water Tower inspection to Bernier Carr for their assessment.

á      Having sent an application to DEC for a new mining permit for the Town sand pit with the assistance of Neil Carey.

á      Having received a certificate from the North Country Chamber of Commerce noting a shared service award with CCRS for the swim program.

á      That Leo Cote suggested that Town place a filter on his water line after the meter and that he would maintain the filter so as to help determine were the problem exists.

 

RESOLUTION AUTHORIZING AN EXPERIMENTAL IN LINE WATER FILTER

WHEREAS, Water District user, Leo Cote continues to have discoloration of his water and suggested an in line filter be installed;

 

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize the Chazy Water District to install an experimental in line water filter after the meter of Leo CoteÕ water line.

 

á      Received a request of approval from the Board, from Assessor Patricia Ayer, to accept a request from the Clinton County Legislative Office to be on the Clinton County Centralized property Tax Administration program committee.

á      Having met with DEC officials on the report of their findings of their inspection of the Sewer plant. Some of the Water & Sewer Supt. reports were late, the need of a building over the sand filter that freezes each winter. A fine of $3,000.00 has been assessed but hope to negotiate for a lesser amount of which will be the responsibility of the Water and Sewer Superintendent.

 

RESOLUTION TO APPOINT SUSAN PATNODE AS ALTERNATE CLERK OF THE BOARD

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby approve the appointment of Susan Patnode as Clerk of the Board in the absence of the Town Clerk.

 

PUBLIC HEARING ON LOCAL LAW NO. 2/TO SAFEGUARD POTABLE WATER SUPPLIES/AMENDMENT TO LOCAL LAW NO. 3 – 07/09/2007

WHEREAS, Sup. Staub Spiegel has introduced Town of Chazy Local Law No. 2 of the year 2008 entitled ÒAn amended Local Law to Safeguard Potable Water Supplies from Potential Contamination by Preventing Back Flow from a Water UserÕs System into the Public Water SystemÓ.

 

            NOW THEREFORE BE IT RESOLVED, that a public hearing will be held on said proposed Town of Chazy Local Law No. 2 of the Year 2008 on the 14th day of April, 2008 at 7:00 oÕclock PM at the Town Hall, 9631 Route 9, Town of Chazy, Clinton County, New York; and it is hereby further

 

            RESOLVED, that the Town Clerk is hereby authorized, and directed to publish and post a Public Hearing Notice to be published in the Press-Republican and on the sign board of the Town maintained pursuant to Town Law ¤30(6), the publication thereof, and said posting to be not less than ten (10) days, nor more than twenty (20) days, before the date set for such Public Hearing.

 

RESOLUTION AUTHORIZING THE USE OF GENERAL TOWN BUILDING CONSTRUCTION TYPE CAPITAL RESERVE FUNDS SUBJECT TO PERMISSIVE REFERENDUM TO SURVEY THE BOAS SAND PIT AND APPLY FOR MINING PERMIT

WHEREAS, Hwy. Supt. Richard Lewis, requests that the Boas sand pit in Town of Mooers be surveyed and make application for new mining permit with funds to come out of General Building Construction Type Capital Reserve Funds;

 

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize Neil Carey to survey and make application for new mining permit, for the Boas sand pit, in the Town of Mooers, at a cost of not more than $9,812.00, of which would come from the General Building Construction Type Capital reserve fund, subject to permissive referendum; and

 

            FURTHER RESOLVED, that the Town Clerk advertise, in the Press-Republican a notice of adoption of resolution subject to permissive referendum, authorizing use of General Building Construction Type Capital reserve funds to make such improvements, not exceeding $9,812.00.
