Supervisor Staub Spiegel called the 06/08/09 Regular Town
Board meeting to order at 7:00 PM.

Councilor Cathy Devins made a motion that the minutes of the 05/11/09 regular Town Board meeting be approved as submitted by the Town Clerk, seconded by Councilor Donald Trombly.

Olmstead, along with Dina Panetta, Miranda Oshier, and Candice Panetta gave a
presentation on a project of the smoke free movies action network.

INSURANCE
Curtis Latremore spoke before the
Board on behalf of the Chazy Fire District about their excessive premium cost
for workmanÕs comp. insurance and possible ways to reduce the premium including
being added to the Town policy. More information to be obtained before a
decision is made.

HIGHWAY SUPERINTENDENT REPORT

Supt. Richard Lewis reports:

Having started grinding the North end of Ridge Road
prior to paving.

The need to discuss the status of the Ingraham road.
A discussion ensued with the Town Board and letter read by Supervisor Staub
Spiegel from Clinton County Hwy. Supt. Al Rascoe stating that records were
found showing that the road in actuality was turned over to the Town from the
State back in 1953, therefore making it already a Town Road. Supervisor Spiegel
to contact Co. Rep. Tom Sears and Clinton Co. Hwy Supt. Al Rascoe for further
information.

On T/Hall renovations. Mostly complete. Would like to
have open house sometime in July. Councilor Jerry Deno suggested having it in
conjunction with the ÒWhat Can We Do For YouÓ day. It was decided they would be
held together on Saturday August 22, 2009 from 9:00 am to 12:00 pm.

On the status of stimulus money for a building at the
sewer plant. Dominic Fontana is attempting to get the project on the list.
á
Clinton County is offering prescription drug cards
through a partnership between the county and ProAct Inc. for people with little
or no insurance coverage for drugs.

RESOLUTION
AUTHORIZING THE TOWN SUPERVISOR TO APPLY WITH THE NYS DOT AND CLINTON COUNTY FOR
HIGHWAY WORK PERMIT

WHEREAS Kevin Mulligan,
Superintendant for Chazy Schools requested that the town inquire about putting
ÒIn Street Pedestrian Crossing SignsÓ at the pedestrian crossing located on
State Route 9 and County, Miner Farm Road in the Town of Chazy New York.
NOW, THEREFORE, BE IT RESOLVED
that the Chazy Town Board does hereby authorize the Town Supervisor to make
application with the State of New York Department of Transportation and Clinton
County Highway Dept. to apply for Highway Work Permit in order for the Town to
get use of an ÒIn Street Pedestrian Crossing SignÓ. The Town board authorizes
the Town Supervisor to send an agreement to the NY State DOT and Clinton County
Hwy. Dept. with the following agreement:

The Town of Chazy agrees to indemnify and hold harmless the ÒState of
New YorkÓ, its servants, agents and employees (including the Department of
Transportation and its Commissioner) against all claims, suits, actions,
damages and costs of every name and description resulting from the use of a
Supplementary Pedestrian Crossing Channelization Devise (SPCCD) and /or
In-Street Pedestrian Crossing Sign distributed by the Department of
Transportation.

untimely death of Neil Carey; and

agreed to perform surveying services of the Chazy Town Hall property;

THEREFORE, BE IT RESOLVED that the Chazy Town Board does hereby authorize
Supervisor Staub Spiegel to sign an agreement with Dean H. Lashway, L.S. to
conduct Boundary Survey of the Town Hall Property, Town of Chazy, N.Y. Tax Id
93.2-1-34, recover and/or replace property corners and prepare map of survey of
same suitable for filing at the County Clerk Office, at a cost of $2,375.00.

SMOKE FREE MOVIES RESOLUTION

Whereas tobacco use is the leading cause of preventable death
and disability in the United States;
Whereas youth ages 12-20 are one-sixth of the U.S.,
population but buy one-quarter of all movie tickets;
Whereas most U.S. movies with tobacco imagery are rated G, PG or
PG-13, and three-quarters of all U.S. live-action films rated PG-13 and 40
percent of films rated G or PG released 1999-2006 feature tobacco;
Whereas exposure to smoking in movies is the primary influence on
half of all new adolescent smokers;
Whereas each year an estimated 390,000 teens start smoking because
of exposure to smoking in movies and 120,000 will die prematurely as a result;
Whereas the tobacco industry has had a long, documented
history of promoting tobacco use and particular brands on screen, while
obscuring its true role;
Whereas the U.S. Centers for Disease Control and Prevention in
2002, 2003 and 2005 listed smoking in movies as a primary reason why the
decline in teen smoking rates has stalled;
Whereas the World Health Organization, America Medical
Association, national PTA, American Heart Association, American Lung
Association, American legacy Foundation, American Academy of Pediatrics,
American Academy of Allergy, Asthma, and Immunology, Society for Adolescent
Medicine, L.A. County Department of Health Services and others endorse getting
smoking out of movies rated G, PG and PG-13;
Now,
therefore be it resolved that the Chazy Town Board hereby endorses the four
objectives of the Smoke Free Movies Campaign:
1. Rate new
smoking movies ÒRÓ, with the sole exceptions being when the tobacco
presentation clearly and unambiguously reflects the dangers and consequences of
tobacco use or is necessary to represent smoking of a real historical figure;
2. Require
producers to certify on screen that no one on the production received anything
of value in consideration for using or displaying tobacco;
3. Require
strong anti-smoking ads before any movie with tobacco use, regardless of
rating;
4. Stop
identifying tobacco brands.
