Deputy Supervisor Jerry Deno called the 06/11/07 Regular Town Board meeting to order at 7:00 PM.

 

MINUTES

 

Councilor Donald Trombly made a motion that the minutes of the 05/14/07 regular Town Board meeting be approved as submitted by the Town Clerk, seconded by Councilor Cathy Devins.

PUBLIC COMMENT

 

            HEALTH INSURANCE OVERVIEW

 

            Tish Biesemeyer, of Burnham Financial Services, presented an overview of the TownÕs current Health Insurance and presented different options that are         available with her recommendations.

 

COUNTY LEGISLATOR REPORT

 

            Clinton County Leg. Tom Sears reports:

           

            That sales tax receipts are still up.

 

ATTORNEY FOR THE TOWN REPORT

 

            Attorney William Favreau reports:

 

¯    That the Article 78 Kalvaitis court case was dismissed.

¯    Resolution No. 52 – 05/14/2007 authorizing pursuance of the conveyance and acceptance of ownership of the Kinsley Road Bridge was sent to Clinton County Highway Dept. and that the County Hwy. Dept. as advised that it has since made the repairs to the bridge and ready for the transfer.

 

 

 

 

KINSLEY ROAD BRIDGE/ACCEPTANCE/TRANSFER OF OWNERSHIP

Councilor Marinus Rovers made a motion to adopt the following resolution, seconded by Councilor Donald Trombly.

            WHEREAS, the Town previously adopted Resolution #52 authorizing the Town             to pursue the conveyance and acceptance of ownership of the Kinsley Road Bridge from the County of Clinton, and

 

            WHEREAS, the Town Board is in receipt of the acknowledgment of the     willingness of William Ashley to accept ownership of the Kinsley Road Bridge            simultaneous with the Town obtaining ownership from the County of Clinton, and

 

            NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of Chazy does hereby agree to accept ownership of the Kinsley Road Bridge to be transferred from the County of Clinton to the Town of Chazy, and

 

            BE IT FURTHER RESOLVED, that the Town Board of the Town of Chazy does hereby agree to convey ownership of the Kinsley Road Bridge to William Ashley, and

 

            BE IT FURTHER RESOLVED, that the Town Board of the Town of Chazy does hereby authorize and direct the Town Supervisor to execute any and all documents necessary to carry out the foregoing resolution.

¯    Having a drafted a Local Law on Flood Damage Prevention to replace Local Law No. 2 of the year 1987 and requests a resolution for Public Hearing on such.

 

PUBLIC HEARING ON LOCAL LAW NO. 2/FLOOD DAMAGE PREVENTION

            WHEREAS, Mr. Donald Trombly has introduced Town of Chazy Local Law No. 2           of the year 2007 entitled ÒA Local Law for Flood Damage Prevention as             authorized by the New York State Constitution, Article IX, Section 2, and   Environmental Conservation Law, Article 36Ó.

 

            NOW THEREFORE BE IT RESOLVED, that a public hearing will be held on said proposed Town of Chazy Local Law No. 2 of the Year 2007 on the 9th day of July, 2007 at 7:00 oÕclock PM at the Town Hall, 9631 Route 9, Town of Chazy, Clinton County, New York; and it is hereby further

 

            RESOLVED, that the Town Clerk is hereby authorized, and directed to publish and post a Public Hearing Notice to be published in the Press-Republican and on the sign board of the Town maintained pursuant to Town Law ¤30(6), the publication thereof, and said posting to be not less than ten (10) days, nor more than twenty (20) days, before the date set for such Public Hearing.

 

PUBLIC HEARING ON LOCAL LAW NO. 3/TO SAFEGUARD POTABLE WATER SUPPLIES

            WHEREAS, Mr. Donald Trombly has introduced Town of Chazy Local Law No. 3           of the year 2007 entitled ÒA Local to Safeguard Potable Water Supplies from            Potential Contamination by Preventing Back Flow from a Water UserÕs System    into the Public Water SystemÓ.

 

            NOW THEREFORE BE IT RESOLVED, that a public hearing will be held on said proposed Town of Chazy Local Law No. 3 of the Year 2007 on the 9th day of July, 2007 at 7:05 oÕclock PM at the Town Hall, 9631 Route 9, Town of Chazy, Clinton County, New York; and it is hereby further

HIGHWAY SUPERINTENDENT REPORT

 

            Highway Supt. Richard Lewis reports:

 

¯    That all of the Town roadsides were mowed for the first time using 2 mowers and 120 gallons of fuel.

¯    Having received a letter from Clear Span stating that they were offering a building for a salt shed at a reduced rate. Lewis to look into it further.

¯    That he would like the Board to approve $40,000 of General Town Building Construction Type Capital Reserve Funds for improvements around the Town Garage.

¯    That he is still pursuing the installation of an outside wood stove and would like the Town Board to approve the purchase of one. Town Board consensus is no yet.

¯    That the cost of a new backhoe would be slightly higher if purchased on State Contract than it would be to purchase a used one. He will continue to get more info.

 

RESOLUTION AUTHORIZING THE IMPROVEMENTS TO THE TOWN GARAGE PROPERTY USING GENERAL TOWN BUILDING CONSTRUCTION TYPE CAPITAL RESERVE FUNDS SUBJECT TO PERMISSIVE REFERENDUM

Councilor Cathy Devins made a motion to adopt the following resolution, seconded by Councilor Jerry Deno.

 

3 ayes, 1 no, 1 absent.  Motion carried.  Ayes - Councilor Jerry Deno, Councilor Cathy Devins, Councilor Donald Trombly.  Noes - Councilor Marinus Rovers.  Absent - Supervisor Staub Spiegel.

 

            WHEREAS, Highway Supt. Richard Lewis, requests improvements be made at the Town Garage property, including rebuilding the base of the paved area and        repaving it.

 

            NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize the afore said improvements to the Town Garage property at a cost of not more than $40,000.00, of which would come from the General Town Building Construction Type Capital reserve fund, subject to permissive referendum; and

 

            FURTHER RESOLVED, that the Town Clerk advertise, in the Press-Republican a notice of adoption of resolution subject to permissive referendum, authorizing use of General Town Building Construction Type Capital reserve funds to make such improvements, not exceeding $40,000.00.

 

TOWN COUNCIL ITEMS

 

            Councilor Marinus Rovers advised that he has seen the oil furnace and small     wood stove at the Town Garage and thought they looked to be in good shape.

 

            Councilor Jerry Deno asked Hwy. Supt. Richard Lewis of the possibility of putting          any extra black top, when paving roads, in front of the West Chazy Fire DistrictÕs             new garage. Lewis will check with West Chazy Fire Dept.

 

            Councilor Donald Trombly would like the Supervisor to check on the need for     extra insurance on the use of an outside wood stove.

 

SUPERVISOR ITEMS

 

            Dep. Supervisor Jerry Deno reports:

 

¯    That a volunteer is needed on the ZBA to replace Joseph Komlos, as he moved to New Hampshire.

¯    On the high water bills issue. Should an exception be made or not. Councilor Marinus Rovers suggested the possibility of some form of exception using the whole yearÕs use against the whole yearÕs allotment of water. The rest of the Board thought it would set precedence and did not want to set one.

¯    Letter received from Fred Reus and notified by Catherine Dumar that they both had leaks that caused an unusually large increase on their water meter readings.

¯    That Ian Garrant 9678 Rt. 9, Chazy, NY has not yet separated his water connection from the apartment house according to an agreement he made when he erected his home.  Attorney for the Town to check to see if it warrants his sending a letter.
