PUBLIC HEARING- THE ADOPTION OF LOCAL LAW NO. 1 OF THE YEAR 2010

TOWN OF CHAZY

                                                      NOTICE OF PUBLIC HEARING

 

PLEASE TAKE NOTICE that a public hearing will be held by the Town Board of the Town of Chazy on Tuesday January 19, 2010 at 7:00 P.M. at the Town Offices located at 9631 Route 9, Chazy, New York regarding the adoption of Local Law #1of the Town of Chazy for the year 2010 for a Local Law amending the Town of Chazy Zoning Law adopted March 9, 1992, amended October 12, 2004, December 13, 2004, and last amended July 10, 2006.

 

PLEASE TAKE FURTHER NOTICE that the environmental significance of said proposed Local Law will be reviewed by the Town Board of the Town of Chazy incident to and as part of said public hearing.  A copy of said proposed Local Law is available for review at the Town Offices of the Town of Chazy.

Proof of notice having been furnished, Supervisor Staub Spiegel called the public hearing on adoption of Local Law No. 1 of the year 2010, to order at 7:00 PM.

 

Supervisor Staub Spiegel presented the Local Law for adoption.  He requested any questions or comments.

 

No questions or comments received.    

 

All persons desiring to be heard were heard.

 

Supervisor Staub Spiegel adjourned the public hearing at 7:02 PM, to be reconvened at the next meeting.

Supervisor Staub Spiegel called the 01/19/2010 Organizational Town Board meeting to order at 7:02 PM.

Councilor Cathy Devins made a motion that the minutes of the 12/14/2009 regular Town Board meeting and the 12/28/2009 be approved as submitted by the Town Clerk, seconded by Councilor Donald Trombly.

PUBLIC COMMENT

 

2010 CENSUS

 

James Gratton of West Chazy, working for the US Census, appeared before the Board to advise that they are looking for census workers and that a test will be given at the Chazy Town Hall on February 2, 2010 at 10:00 am.

 

ATTORNEY FOR THE TOWN REPORT

 

            Attorney William Favreau reports:

 

That Local Law No. 1 needs to have a SEQR review form completed before the Law can be passed.

Also, that the Local Law needs to be referred to the County Planning Board before it is passed.

 

HIGHWAY SUPERINTENDENT REPORT

 

            Highway Supt. Richard Lewis reports:

 

An engine was found to repair the truck that had a bad engine and is back in service.

 

TOWN COUNCIL ITEMS

 

Councilor Christopher Latremore Discussed The Following With The Board:

 

á      Asked if the Town has seen a savings having switched from NYSEG Solutions to Agway. Has yet to be determined.

á      Problems with the Church Street water lines. A surge was caused when CCRS shut off their main water valve and reopened it. Sup. Spiegel looking into having a slow start or a soft start valve installed at the school so as to help avoid brown water in the future.

á      Was there any equipment loaned to Dannemora Hwy dept? Supt. Lewis advised that as of this time no. Our spare truck was in service while the truck with the bad engine was out of commission.

á      Checking with Dept of Corrections for work details in the spring to paint, etc.

Councilor Cathy Devins Discussed The Following With The Board:

 

á      Snow being piled up on the sidewalk at the intersection of Church St. and Route 9. Sup. Spiegel will send a letter to owner of property to advise against piling up snow on the sidewalk.

á      The need for a couple more decorations in West Chazy at the North end.

á      Is salt obtainable by property owners from the Highway Dept. Supt. Lewis advised that a combination of salt and sand or just sand is available at the Highway Garage.

á      Is there still a need for road crossing guards? Yes.

á      The Chazy sign just south of the Hamlet of Chazy is pealing.

á      Light out near her home. Will get pole number to report it.

 

Councilor Donald Trombly Discussed The Following With The Board:

 

á      Having been contacted by Willard Martin, who questioned the feasibility of having community service people clean the sidewalks. Sup. Spiegel advised not and that there might be a list at the school of kids that would shovel snow.

á      River Street and the lack of guard rails. Supt. Lewis will check on it.

á      The subject of a new law affecting the ownership of dams.

á      Anything new about the Ingraham Road. No.

 

SUPERVISOR ITEMS

 

            Supervisor Staub Spiegel reports:

 

á      On the Pfizer situation. There are a couple of interested parties for purchasing the plant in Chazy.

á      Receiving a letter from NYSEG advising that they would not be sending out any surveys for natural gas, as they have determined it would be a negative for them to pursue. Councilor Latremore advised that he was very disappointed in NYSEG for not pursuing it.

á      The burned out house on the Miner Farm Road has a new owner and is being torn down.

á      North Country Youth Ski & Snow Board Club has a ski program that has approximately 30 Chazy students participating and would like the Town of Chazy to send Northeastern Clinton Central School approx. $500.00 to help defray the cost of transportation of ski trips.

 

JCEO AGREEMENT FOR 2010

            WHEREAS, the Town Board of the Town of Chazy (hereinafter referred to as the ÒTown BoardÓ and/or ÒTownÓ) is considering the enactment of a Local Law entitled ÒLocal Law Amending the Town of Chazy Zoning Law adopted March 9, 1992, amended October 12, 2004 amended December 13, 2004 and last amended July 10, 2006Ó; and

 

            WHEREAS, The ÒState Environmental Quality ReviewÓ, (hereinafter referred to as the ÒSEQRÓ) of the Environmental Conservation Law provides for the review of projects which constitute and ÒactionÓ with respect to the effect of such projects on the environment; and

 

            WHEREAS, a determination of the effect of said project or action on the environment is necessary to determine whether a draft ÒEnvironmental Impact StatementÓ is required; and

 

            WHEREAS, the effects of the project or action on the environment are to be examined by all Òinvolved agenciesÓ to make such determination; and

 

            WHEREAS, the Town Board has before it the project or action known as the Proposed Local Law entitled ÒLocal Law Amending the Town of Chazy Zoning Law adopted March 9, 1992, amended October 12, 2004, amended December 13,2004 and last amended July 10, 2006Ó; and

 

            WHEREAS, the Project has been determined and is hereby determined to be a TYPE 1 Òlisted actionÓ requiring the assessment as to its effect upon the environment.

 

            NOW, THEREFORE, it is hereby

 

            RESOLVED by the Town Board of the Town of Chazy, New York, as follows:

 

1.                The Town Board does hereby declare itself by Resolution the Òlead agencyÓ in accordance with the provisions of SEQR for purposes of assessing the effect of the Project on the environment and determining whether said effect is sufficiently significant to require the preparation of a ÒDraft Environmental Impact StatementÓ, and be it further

 

RESOLVED, that the Town Clerk is hereby directed and authorized to notify all interested and involved agencies of the TownÕs declaration of Òlead agencyÓ status for purposes of conducting a coordinated review of the environmental impacts of the proposed adoption of the amendment to the zoning ordinance.
