CALL MEETING TO ORDER
Supervisor Staub Spiegel called the 02/11/08 Regular Town Board meeting to order at 7:00 PM.
MINUTES
Councilor Donald Trombly made a motion that the minutes of the 01/14/08 organizational Town Board meeting be approved as submitted by the Town Clerk, seconded by Councilor Cathy Devins.

REPORTS
The Supervisor and Town Clerk January monthly reports submitted to Board for review and filed.
T/J Dunlop and T/J Gagnier 2007 Annual reports submitted to Board for review.
PUBLIC COMMENT
PLANNING BOARD DISCUSSION/WILLIE KALVAITIS
Willie Kalvaitis discussed with the Town Board the fact that the Planning Board Chairman needs to refrain from comment and decision on sketch plan presented by the Chairman Tom Dashnaw and that another chairman needs to be appointed for that proceeding.
It was also brought up, the need for alternate Planning Board members. The Board advised Mr. Kalvaitis to advise anyone that wishes to become a participating alternate member to contact the Supervisor.
ATTORNEY FOR THE TOWN REPORT
Attorney William Favreau reports:
á The need for added language to the Dog Control agreement with the Town of Mooers.
á Having a Town Law for cold war Veterans exemption for the Town Board to act on.
á Having a draft no parking law for Gonyea Road to be looked at by the Town Board to determine if they wish to pursue it.
HIGHWAY SUPERINTENDENT REPORT
Highway Supt. Richard Lewis reports:
á Having made a wood splitter hitch for the tractor at a cost of approx. $500.00.
á That he would like to thank Mike Russell for the use of his hitch while the Hwy. Dept. made theirs.
á That he believes that the Hwy. Dept. is alright with the amount of sand and salt on hand.
á That DEC has notified him that the sand pit permit is to expire on 03/28/2008 and requests that the Town acquire Neil Carey to apply for the new permit for the Town.

WHEREAS, the DEC permit for the Town of Chazy Sand Pit needs to be renewed;
NOW, THEREFORE, BE IT RESOLVED that the Chazy Town Board does hereby authorize Supervisor Staub Spiegel to acquire someone to help with submitting an application for a DEC permit renewal for the Town sand pit in Mooers.
TOWN COUNCIL ITEMS
COUNCILOR CHRISTOPHER LATREMORE DISCUSSED THE FOLLOWING WITH THE BOARD:
á Burn barrels and outside wood stoves.
á The need for a changeable sign in front of the Town Hall that can be used to notify people when water needs to be boiled, Town Board Meetings, etc.
á The progress in applying for a grant for a salt shed at the Hwy. Dept.
COUNCILOR JERRY DENO DISCUSSED THE FOLLOWING WITH THE BOARD:
á The addition of a new fire truck and being put in service at the West Chazy Fire Dept.
á Would like the Attorney for the Town to check to see if it would be a conflict of interest if he were to accept the position as Fire Commissioner for the West Chazy Fire District.
COUNCILOR CATHY DEVINS DISCUSSED THE FOLLOWING WITH THE BOARD:
á She advised that it is much better since the sidewalk by the Church was repaired. No flooding.
COUNCILOR DONALD TROMBLY DISCUSSED THE FOLLOWING WITH THE BOARD:
á The reporting of Street Lights not working properly.
SUPERVISOR ITEMS
Supervisor Staub Spiegel reports:
á Maint. Man Conrad Bechard out with shoulder ailment until Feb. 13th. Tom Roberts is filling in as needed.
á Letter sent requesting Masonic signs.
á Receiving thank you letter from Larry Hahn, Director of the Dodge Library for the assistance in the placement of a sign on Rt. 22.
á Having received a thank you note from the Latremore Family for the donation to the Fire Dept. in memory of Mary Latremore.
á That the Town has received another complaint of dirty water from Alice Cote. Will attempt several ways of determining what the cause is.
á That David Siskavich requests payment of schooling by the Town. The Board consensus was no as he is under contract and should be his responsibility.

ADDITION TO DOG CONTROL AGREEMENT

WHEREAS, Attorney for the Town of Chazy, William Favreau, advises that extra language be added to the Dog Control Officer agreement with the Town of Mooers;
NOW, THEREFORE BE IT RESOLVED that the Chazy Town Board does hereby request that the following language be added to the Dog Control Officer agreement with the Town of Mooers:
1. Under Duration of Contract, add at the end of the sentence Òor earlier upon a thirty (30) day written notice by either party to this agreement.Ó
2. Add an Indemnification Agreement indicating that the Town of Mooers agrees to indemnify and hold harmless the Town of Chazy from any and all claims arising out of services performed hereunder, including those specifically arising out of the negligent acts or omissions of the Dog Control Officer.
RESOLUTION ADOPTING LOCAL LAW NO. 1 OF THE YEAR 2008/COLD WAR VETERANSÕ EXEMPTION

WHEREAS, The Town Board is interested in considering the adoption of a Local Law which allows an exemption from real property taxes in accordance with the provisions outlined in Real Property Tax Law Section 458(b) – Cold War Veterans Exemption; and
WHEREAS, Real Property Tax Law Section 458(b) provides that a Cold War Veterans exemption is available only for residential property of veterans who served during the cold war period. Local law maximums can be set as follows:
Cold War Veteran 15% of assessed value to a maximum of $12,000
Disabled Cold War Veteran 15% of disability rating to a maximum of $40,000
WHEREAS, the Town Board having called a public hearing on January 14, 2008, notice of which was given by publication thereof in the official newspaper of said Town at least ten days before the hearing, and the Board having duly convened and held said hearing; and
NOW, THEREFORE, BE IT RESOLVED, Local Law 1 of the year 2008 is hereby adopted to establish a Cold War VeteranÕs Exemption as follows:

Local Law No. 1 of the Year 2008
A LOCAL LAW PROVIDING FOR THE
EXEMPTION FROM REAL PROPERTY TAXES
(COLD WAR VETERANSÕ EXEMPTION)
BE IT ENACTED, by the Town Board of the Town of Chazy, in the County of Clinton as follows:
Section I TITLE:
The purpose of this law is to provide an exemption from real property taxes in accordance with and subject to the provisions of Section 458(b) of the Real Property Tax Law (Cold War Veterans Exemption).
Section II EXEMPTION PROVIDED:
Individuals who qualify under the provisions of Section 458(b) of the Real Property Tax Law shall receive a real property tax exemption to the extent provided in the following schedule:
Cold War Veteran 15% of assessed value to a maximum of $12,000
Disabled Cold War Veteran 15% of disability rating to a maximum of $40,000
Section III INCONSISTENCY:
This Local Law is intended to supersede and amend any other Local Law or provision to the contrary. All resolutions, ordinances or local laws or portions thereof of the Town of Chazy not consistent with this ordinance, in whole or in part, shall be deemed amended and/or modified so as to give full force and effect to the intent of this law.
Section IV EFFECTIVE DATE:
This Local Law shall take effect immediately upon filing with the New York State Secretary of State and shall become first effective for the 2009 tax year.
