Supervisor Staub Spiegel called the 02/14/2011 Regular Town Board meeting to order at 7:00 PM.

MINUTES

Councilor Donald Trombly made a motion that the minutes of the 01/10/2011 organizational Town Board meeting and the 01/31/2011 Special Town Board meeting be approved as submitted by the Town Clerk, seconded by Councilor Cathy Devins.

AT&T PROPOSAL TO INSTALL/COLLOCATE A WIRELESS COMMUNICATIONS FACILITY

Stephen Woodward, site acquisition Specialist, gave a presentation of what AT&T proposes to install/collocate a wireless communications facility (“cell site”) on the existing Verizon tower located off Route 9, in the town of Chazy. He gave AT&T’s reasons for wanting to use the Verizon Tower opposed to the Town of Chazy’s Water tower.

SUPERVISOR ITEMS

Supervisor Staub Spiegel reports:

• Thank you to Highway Dept. for good snow removal job.
• NYS DOT advises that the bridge over interstate 87, on the Miner Farm Road, is planned to be rebuilt in 2014.
• Advised by Clinton County that the Town may offer any or all of the old voting machines to the school or scrap them for whatever money can be gotten or turn over to the County to scrap them.
• Clinton County advises that the final cost for the 2010 elections was $7,911.00.
• Received request from Codes Officer, Frank Slycord, for permission to purchase code enforcement software from B.A.S. for $5,959.00
• Agreement with ADEA was signed.
• Receiving a letter from Assembly woman Janet Duprey advising that the Chips money to remain the same.
• Would like to possibly purchase a snow blower for one of the lawn tractors to help with snow removal.
• Clinton County reports that they expect there will be no extra sales tax revenue this year.

• Update on Pfizer - nothing new.
• Update on Sewer Plant building – waiting for stamping of blue prints.
• Update on JCEO replacement – no one yet, but being taken care of by other internal JCEO people.
• Update on Ingraham Road – Attorney Mark Rogers working on it.
• Brush cutting at Riverside Cemetery – No violation exists as per NYS DEC.

Councilor Cathy Devins Discussed The Following With The Board:

• Update on painting of pedestrian crossing lines on Route 9 just North of Post Office – NYS Dot has not been contacted yet by Supervisor.

Councilor Jerry Deno Discussed The Following With The Board:

• Update on County Bridge on West Church Street in West Chazy – Have not seen or heard anything from the Clinton County Highway Dept.

Councilor Christopher Latremore Discussed The Following With The Board:

• Applauds the Town people who have been cleaning their sidewalks.
• Owner of Grey Gables, Fred Reus, needs to be advised that his sidewalk needs to be cleaned. A letter should be sent advising him that the sidewalks need to be cleaned.

RESOLUTION TO ACCEPT 2011 CONTRACT WITH TOWN OF MOOERS FOR THE SHARED SERVICES OF DOG CONTROL OFFICER TODD A. FORETTE

WHEREAS, the Town of Mooers agrees to share the Dog Control Service of Todd A. Forette for $8,250.00 a year;

NOW, THEREFORE BE IT RESOLVED, that the Chazy Town Board does hereby authorize the Supervisor to sign a contract with the Town of Mooers for sharing Dog Control Officer Todd A. Forette for the amount of $8,250.00 a year.

AUTHORIZATION OF TOWN OFFICIAL TO ATTEND THE ANNUAL ASSOCIATION OF TOWNS MEETING IN NYC

WHEREAS, Town Clerk/Tax Collector Leo Oliver requests to attend the 2011 Association of Towns Annual Meeting Feb. 20-23, 2008 in NYC;

NOW, THEREFORE BE IT RESOLVED that the Chazy Town Board does hereby authorize Town Clerk/Tax Collector Leo Oliver to attend the Association of Towns Annual Meeting Feb. 20-23, 2011 in NYC; and further

RESOLVED, that the registration, meals, transportation and hotel fees be paid from his appropriation account.

TOWN OFFICIALS ADVANCE FOR ANNUAL ASSOCIATION OF TOWNS MEETING

Resolution: 11-31 02/14/2011

WHEREAS, Town Clerk/Tax Collector, Leo Oliver has been authorized to attend the annual Association of Towns meeting in NY City on Feb 20-23, 2011; and

WHEREAS, an advance of $300.00 is requested to cover meals and other needed expenses;

NOW, THEREFORE, BE IT RESOLVED that the Chazy Town Board does hereby authorize that Leo Oliver will be advanced $300.00 for the Association of Towns meeting in NY City on February 20-23, 2011.

RESOLUTION AUTHORIZING THE CODES ENFORCEMENT OFFICER TO USE GENERAL EQUIPMENT TYPE CAPITAL RESERVE FUNDS SUBJECT TO PERMISSIVE REFERENDUM TO PURCHASE SOFTWARE PROGRAM

WHEREAS, Code Enforcement Officer, Frank Slycord, requests that he be allowed to purchase a software program with funds to come out of General Equipment Type Capital Reserve Funds;

NOW, THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby authorize the Code Enforcement Officer to purchase a Business Automation Services, Inc. software program for the Codes Enforcement Office to create and track building permits, variances, violation notices, appearance tickets, certificate of compliance, certificate of occupancy, stop work orders and will integrate with the Tax Assessor’s Tax Map information via network, at a cost of not more than $5,995.00, of which would come from the General Equipment Type Capital reserve fund, subject to permissive referendum; and

FURTHER RESOLVED, that the Town Clerk advertise, in the Press-Republican a notice of adoption of resolution subject to permissive referendum, authorizing use of General Equipment Type Capital reserve funds to make such improvements, not exceeding $5,995.00.

WATER RATES-EXTENDED TIME AWAY/VACANT

Resolution: 11-33 02/14/2011

WHEREAS, people in the water district may call to have water turned off at curb stop due to extended time away, and businesses who are no longer in business who ask that their meters be removed;

NOW, THEREFORE BE IT RESOLVED, that the Chazy Town Board does hereby authorize that normal water rates, will apply to residences in water district for their extended time away which will include water usage, debt service, and O & M charges. Debt service charges only, will apply on all parcels that are vacant. Vacant means the building is empty and not in use.

RESOLUTION TO ACCEPT FOUR YEAR AGREEMENT FOR CENTRAL STATION MONITORING OF FIRE ALARM SYSTEM

Resolution: 11-34 02/14/2011

WHEREAS, for a four year agreement has been requested between the Mahoney Notify-Plus Inc. and Town of Chazy for Central Station monitoring of fire alarm system at the Highway garage;

NOW, THEREFORE BE IT RESOLVED that the Chazy Town Board does hereby authorize the Supervisor to sign an agreement between the Mahoney Notify-Plus Inc. and Town of Chazy for Central Station monitoring of fire alarm system at the Highway garage to begin March 1, 2011 and shall run for a period of four (4) years at a cost of $27.00 per month, billed semi-annually.
