HEARING RECONVENED ON THE ADOPTION OF LOCAL LAW NO. 1 OF THE YEAR 2010
Supervisor Staub Spiegel reconvened the public hearing of
January 19, 2010, on adoption of Local Law No. 1 of the year 2010 at 7:00 pm.
Supervisor Staub Spiegel presented the Local Law for
adoption. He requested any
questions or comments.
No questions or comments received.
All persons desiring to be heard were heard.
Supervisor Staub Spiegel closed the public hearing at 7:02
PM.

MEETING TO ORDER
Supervisor Staub Spiegel called the 02/08/2010 Regular Town
Board meeting to order at 7:02 PM.
MINUTES
Councilor Donald Trombly made a motion that the minutes of the 01/19/2010 organizational Town Board meeting be approved as submitted by the Town Clerk, seconded by Councilor Cathy Devins.

Audrey Tedford appeared before the board to give an update on the services
offered by the JCEO Community Outreach Program.
TOWN COUNCIL ITEMS
Councilor Donald Trombly Discussed The Following With The Board:

The re-surfacing of the West Chazy Tennis Courts and
if Beekmantown Central School was going to supply any funds. Unknown at this
time.
á
Any further action with the wish list. No.
á
Dog Control – Sup. Spiegel advised that a dog
had been hit in West Chazy and the dog was brought to Plattsburgh Animal Hosp.
and the Dog Control officer authorized Dr. Brown to accept the dog at a cost to
the Town of $99.00. The dog was adopted by the person who brought the dog in
who also paid over $500.00 in veterinarian bills.

PhizerÔs attempt to find a buyer for the Chazy plant.

Guard rails along River Street.
Councilor Cathy Devins Discussed The Following With The Board:

Have sidewalk concerns been dealt with? Letters sent
out to three property owners about not piling snow on sidewalks per Sup.
Spiegel.

Street light at the intersection of Miner Farm Road
and Stetson Road is now working properly.
á
Burned out house on Miner Farm Road – progress
report – Sup Spiegel advises it has been taken down.
á
Progress with the ski program – awaiting response
from NCCS.
á
How is Tom Roberts making out – Doing excellent
per Sup. Spiegel.
á
Any Water problems? Per Sup. Spiegel there was 1
report of brown water a few days ago but nothing else.

CafŽ water line – Bill of the repair has been
sent to the owner.

An update of what is happening with Dr. ClarkÕs
house.

The library taking over Dr. ClarkÕs office.

Water district projects for 2010 – Tank to be
re-painted.

Old building at the West Chazy Rec. Park – To
remove walls and make a pavilion out of it.

Tennis Court at W. Chazy Rec. Pk – Resurfacing
and if BCS will contribute funds.
Councilor Christopher Latremore Discussed The Following With The Board:

The need of repairs to the walls of the Railroad
underpass. CN RR has responsibility.
á
Old bath room at Chazy Rec. Park – to be
removed.
á
New software for collection taxes by credit card
– Tax Col. Leo Oliver advised it was going well and that only three
people have used it to date.
HIGHWAY SUPERINTENDENT REPORT
Highway
Supt. Richard Lewis reports:
á
The cutting of brush etc. along the Slosson Road is
being done.
á
Preventative maintenance is being performed on all
equipment.
á
It is being looked into to have shut offs put on all
trucks so as to shut off all electrical on the trucks when not in use so as to
help prevent any possible fires.

William Favreau reports:

Attempting to contact the attorney for Wyeth/Phizer
on article 7 for tax assessments.

SUPERVISOR ITEMS
Supervisor
Staub Spiegel reports:
á
Advised we would be put on the list for prison workers
to come in the spring. Work will be limited.
á
Advised by Sheriff Dave Favreau that the County
prisoners may be available at times.
á
Sending a letter to Jan Davis on behalf of the Chazy
Fire Dept. about the new responsibility of certain reports that need to be
filed as being an owner of a dam.
á
Pealing sign south of Chazy hamlet was replaced.
á
Valve to be installed at CCRS has yet to be
determined as to who will be responsible. Will contact Mr. Mulligan.
á
Census work is beginning. Workers needed. Tests to be
given at the Chazy Town Hall on Feb. 11 and 26, 2010.
á
Water Tank to be painted. Quotes will be sought.
á
Minor renovations needed at the Chazy Town Hall. New
bathroom configuration may be done if Health dept. approves. Some eve work and
some wood work to the building need repairs.

JUSTICES ANNUAL 2009 REPORTS REVIEWED

Unified Court System requires a resolution acknowledging that the 2009 annual
reports from the Chazy Town Justices were reviewed by the Chazy Town Board;

THEREFORE, BE IT RESOLVED, that the Chazy Town Board does hereby verify that
the 2009 annual reports of the Chazy Town Justices were reviewed by the Chazy
Town Board at this regular Town Board meeting.

IN THE MATTER OF THE
TOWN OF CHAZY
CHAZY, NEW YORK
ENVIRONMENTAL DETERMINATIONS RESOLUTIONS
WHEREAS,
the Town Board of the Town of Chazy (hereinafter referred to as the
ÒTown BoardÓ and/or ÒTownÓ) is considering the enactment of a Local law
entitled ÒLocal Law Amending the Town of Chazy Zoning Law adopted march 9,
1992, amended October 12, 2004, amended December 13, 2004 and last amended July
10, 2006Ó ; and
WHEREAS, the ÒState Environmental
Quality ReviewÓ, (hereinafter referred to as the ÒSEQRÓ) of the Environmental
Conservation Law provides for the review of projects which constitute an
ÒactionÓ with respect to the effect of such projects on the environment; and
WHEREAS, the Town Board has previously
declared itself to be Òlead agencyÓ in accordance with the provisions of SEQR
for purposes of assessing the effect of the Project on the environment and
determining whether said effect is sufficiently significant to require the
preparation of a ÒDraft Environmental Impact StatementÓ, and
WHEREAS, THE Town Board, acting as the
Òlead agency,Ó has received a completed Full Environmental Assessment Form
(Parts 1, 2 and 3) a true copy of which is attached hereto and related
materials giving information about the Project and its potential effects on the
environment (collectively, the ÒEnvironmental Compliance FileÓ).
NOW, THEREFORE, it is hereby
RESOLVED, The Town Board hereby
determines, based upon all currently available information, after careful
review and consideration of the Environmental Compliance File, that the Project
supported by the issuance of obligations of the Town will not have a
significant effect on the environment. Accordingly, the preparation of a draft
ÒEnvironmental Impact StatementÓ is
not required at this time, and be it further
RESOLVED, The ÒNotice of No Significant
Environmental ImpactÓ (Negative Declaration) following such further
environmental compliance review, shall be disseminated to those Òinvolved
agenciesÓ and governmental units as required by the Environmental Conservation
Law and any local law of the Town, and the Environmental Compliance File, as
aforesaid, shall be maintained on file at the Town Hall Offices of the Town
Board and made available for public inspection at regular business hours of the
Town.
THIS RESOLUTION shall become effective
immediately upon its adoption by the Town Board of the Town.

AUTHORIZING THE PURCHASE OF AN APOLLO BALL VALVE

requests authorization to purchase a soft start/slow start valve assembly to
install in Chazy Central Rural SchoolÕs water line;
NOW,
THEREFORE, BE IT RESOLVED that the Chazy Town Board does hereby authorize the
purchase of a soft start/slow start valve assembly from Aird Dorrance at a cost
of $1,039.35 to be installed in the water line servicing Chazy Central Rural
School to help alleviate causing dirty water in the water lines.

WHEREAS, Town Board Member, Councilor Christopher Latremore,
at the Town Board Meeting
held on February 8, 2010, introduced
Town of Chazy Local Law No. 1 of
the year 2010 entitled:
ÒA LOCAL LAW AMENDING THE TOWN OF CHAZY ZONING LAW
ADOPTED MARCH 9, 1992, AMENDED OCTOBER 12, 2004, DECEMBER 13, 2004 AND LAST
AMENDED JULY 10, 2006Ó,
and
WHEREAS, a public hearing was held on said proposed
Town of Chazy Local Law No. 1 of
the year 2010, on January 19, 2010 and again on February 8, 2010, at 7:00 p.m.
prevailing time, at the Town Hall, Town of Chazy, Clinton County, New York, and
WHEREAS, the Town has completed a review and
assessment of the environmental impacts of proposed local laws as required by
the State Environmental Quality Review Act, and
WHEREAS, the Town has properly referred the
proposed Local Law to the County Planning Board as required by ¤239M of the Town
Law;
NOW, THEREFORE BE IT RESOLVED that it is the
opinion of the members of the Town Board that the best interests of the Town of
Chazy would be served by the adoption of said proposed Local Law No. 1 of the year 2010, and prompt filing
of said law as adopted with the Department of State of the State of New York in
order for said Local Law to become effective at the earliest possible date; and
it is hereby further
RESOLVED, that proposed Local Law No. 1 of the year 2010 as afore mentioned,
be, and the same hereby is, adopted as Local Law No. 1 of the year 2010, and it is further
RESOLVED, that the Town Attorney, acting for the
Town Clerk, be, and he hereby is, directed to cause said Local Law No. 1 of the year 2010 to be duly filed
with the Department of State of the State of New York.
